We would like to update you on implementation of the UEFA European Championship (Scotland) Act 2026, in particular the offence to sell a EURO 2028 ticket for above face value or with a view to making a profit. The penalty for the offence is up to £20,000 on summary conviction or, on indictment, an unlimited fine. The UEFA European Championship (Scotland) Act 2026 (Commencement No. 1) Regulations 2026 have brought this offence into force, along with the powers necessary to enforce it.
The Act provides for some limited situations in which the offence will not apply. This includes a charity auction exemption, where a registered charity may auction a ticket to raise funds, provided that the proceeds of the ticket’s sale are given to charity. This only applies to registered charities; tickets should not be auctioned for other bodies or types of fundraising. If a charity is auctioning a ticket, we recommend checking the ticket’s terms and conditions to make sure that the auction would not void the ticket.
We would encourage you to share information about the EURO 2028 ticket touting offence with your networks, to help raise awareness and ensure that people and organisations do not inadvertently fall foul of the law.
We are also currently working to identify the times and places that the street trading and advertising provisions will have effect, ahead of laying regulations.
